Terms for using Proud's catalog and inquiry website.

These Terms of Use govern access to and use of the advertising-media catalog and inquiry website operated by Proud Khosana Co., Ltd. ("Proud," "we," or "us"). This website is an information and inquiry channel only. It is not an online booking or payment platform.
2.2 Permitted use
You may visit the website, review media information, and contact Proud for lawful and honest purposes. You must not use the website to cause harm, disrupt its operation, gain unauthorized access, introduce harmful material, impersonate another person, or violate any law or another person's rights.
2.3 An inquiry is not a booking
Sending an inquiry, receiving a response, or having any preliminary communication does not reserve media space and does not create a booking contract, advertising-services contract, other agreement, or guarantee that space or a campaign will be available.
2.4 Separate written confirmation
Each campaign can proceed only after its terms have been separately agreed and confirmed in writing by an authorized Proud representative. That confirmation will define the scope and terms that apply to that campaign.
2.5 Availability, pricing, and campaign terms
Placement availability, price, deposits, artwork specifications, campaign dates, cancellation or refund terms, and any operational agreement are separately confirmed in writing. Catalog information and an initial inquiry response do not replace that written confirmation.
2.6 Advertising content and advertiser obligations
At the point of any separately agreed campaign, the advertiser must provide advertising content that is accurate, lawful, and not misleading, and must have all required rights, licenses, disclosures, and approvals. The advertiser is responsible for its claims, disclosures, and submitted materials, and for meeting the agreed artwork specifications and deadlines. Proud may reject, require changes to, suspend, or remove content that it reasonably considers unlawful, infringing, or inconsistent with the agreement.
2.7 Intellectual property
Website content, images, designs, catalog materials, names, marks, and other intellectual property belong to Proud or its licensors. You must not copy, adapt, distribute, publish, or use them commercially without written permission. Rights in material submitted by an inquirer or advertiser remain subject to that owner's rights; Proud may use submitted material only as reasonably needed to evaluate or carry out an agreed campaign.
2.8 Information and no availability guarantee
Catalog information is provided for consideration and may change. Proud does not guarantee that any placement or media will remain available, that the website will be uninterrupted, or that information will always be complete and current. A listing on the website is not a guarantee that the placement is available.
2.9 External links and information
The website may include links or information from external sources for convenience. Proud does not control or endorse their content, security, or availability. Accessing an external source is at your own risk.
2.10 Force majeure
Proud is not responsible for delay, interruption, or failure to perform caused by circumstances beyond its reasonable control, including natural disaster, fire, flood, epidemic, government action, network or power failure, cyberattack, or a failure of a service provider.
2.11 Limitation of liability
To the extent permitted by law, Proud is not liable for indirect, special, consequential, or incidental loss, or for lost profits, revenue, data, or business opportunity arising from or relating to use of the website, website information, or website unavailability. Nothing in these Terms limits liability that cannot lawfully be limited.
2.12 Indemnity
You agree to indemnify and hold harmless Proud, its directors, employees, and service providers from claims, losses, liabilities, costs, and reasonable legal fees arising from your use of the website, your breach of these Terms, or advertising content and information you submit, to the extent permitted by law.
2.13 Suspension and termination
Proud may suspend or end your access to the website or your communications if it reasonably believes that you have breached these Terms, a law, or another person's rights, or if needed to protect the website or its users. Suspension or termination does not affect rights or obligations already arising under a separately confirmed written agreement.
2.14 Governing law, changes, and contact
These Terms are governed by Thai law. We may update these Terms by posting a revised version on the website; a change does not amend a separately confirmed campaign agreement unless that agreement or applicable law permits it. Nothing in these Terms waives or limits statutory privacy or data-protection rights.
